Key practice areas

Competition law

Agreements, merger control, the DMA and proceedings before Poland’s competition authority (UOKiK).

Examples of our support.

  • Anticompetitive agreements — horizontal and vertical

We help businesses structure cooperation with competitors, suppliers and distributors safely. We review distribution agreements, sales arrangements, pricing policies and information exchange rules, and identify solutions that reduce antitrust risk without obstructing commercial objectives.

  • Abuse of a dominant position

We support businesses with strong market positions in designing commercial terms that allow them to grow while remaining compliant with competition law. Our work includes reviewing pricing policies, relationships with business partners, and conditions for access to products, services and essential infrastructure.

  • Merger control

We guide businesses through the antitrust aspects of a transaction, from the initial assessment of notification requirements and regulatory risk to preparing a complete filing. We represent clients before the relevant authorities and support the efficient clearance of the transaction.

  • DMA — Digital Markets Act

We help businesses navigate their relationships with major digital platforms subject to the DMA. We advise on gatekeeper obligations and the practical exercise of business users’ rights, including in engagement with platforms and EU institutions.

  • Unfair use of contractual advantage

We review agreements, commercial terms and trading practices in agricultural and food supply chains. We help identify and mitigate risks arising from the unfair use of contractual advantage and prepare businesses for engagement or proceedings before the President of UOKiK.

  • Late payments

We analyse payment practices, payment terms and settlement records to identify the risk of excessive delays at an early stage. We support businesses in preparing explanations and defence strategies and represent them in proceedings concerning late payments.

  • Foreign direct investment screening (FDI)

We assess whether a proposed investment or transaction is subject to FDI screening and reflect that assessment in the project structure and timetable. We prepare the required notifications and support clients in proceedings before the relevant authorities.

  • Proceedings before the President of UOKiK

We develop the case strategy from the authority’s first contact through to the conclusion of the matter. We prepare submissions and supporting arguments, represent clients in preliminary investigations and antitrust proceedings, and provide support during inspections and searches.

  • Antitrust compliance

We design compliance solutions tailored to the business’s actual risk profile, from audits and internal procedures to practical training for teams. If a potential infringement is identified, we help assess the situation, protect the company’s interests and select the appropriate response, including possible use of a leniency programme.

  • Private enforcement

We assess whether a competition law infringement may give rise to a damages claim and determine its potential scope. We support clients in bringing and defending claims, combining legal arguments with an analysis of the infringement’s economic effects.

  • Unfair competition

We help protect trade secrets, business and product identifiers, and other commercial interests against unfair market conduct. We assess competitors’ practices, including advertising, imitation and misuse of confidential information, and select legal remedies suited to the nature and scale of the infringement.
