• Market access and operating requirements

  We help businesses enter energy markets and develop activities involving the generation, storage, trading and supply of electricity, gas and heat. We analyse the applicable requirements and manage applications for licences, promises to grant licences and necessary registrations.

• Renewables, energy storage and new technologies

  We handle the legal aspects of developing solar, wind, biogas, biomethane and energy storage projects. We help select the project structure, secure rights to real estate, obtain the required approvals and prepare investment documentation.

• Grid connection and infrastructure access

  We analyse connection conditions and network access rules and draft and negotiate connection agreements. We also support clients in disputes involving connection refusals and the performance of infrastructure operators’ obligations.

• Energy purchase and sale, and PPAs

  We draft and negotiate agreements for the sale, distribution and supply of energy, including long-term PPAs and corporate PPAs. We structure pricing mechanisms, security arrangements, liability provisions and the allocation of regulatory-change risk.

• Support schemes and market instruments

  We assess eligibility for renewable energy support schemes and the capacity market and advise on guarantees of origin and energy efficiency certificates. We also help combine support instruments correctly under the applicable state aid rules.

• Proceedings before the President of URE

  We represent businesses before the President of URE in licensing, tariff and administrative fine matters. We prepare applications, positions and responses and support compliance with information and reporting obligations.

• Competition and compliance in energy markets

  We help structure cooperation between energy market participants, information exchange and access to infrastructure safely. We also advise on REMIT, including disclosure and reporting obligations and the prevention of market manipulation and insider trading.

• Energy sector transactions and investments

  We conduct legal and regulatory due diligence of energy projects and companies and prepare transaction documents. We assess merger control and FDI requirements and the transaction’s effect on licences, contracts and public support received.

• Energy policy and Regulatory & Public Affairs

  We assess how Polish and EU energy initiatives may affect the client’s operations, investments and market position. We develop regulatory strategies, prepare positions and draft provisions, and support engagement with URE, public authorities, EU institutions and industry associations.
